Terms of Use

These terms cover your use of Crumbly: Kids ABC & 123 ("Crumbly", "the app"), made by homeapps ("we", "us"). They're written in plain language for parents and guardians. By downloading or using the app, you agree to them. If you don't agree, please don't use the app.

Apple's standard license

Crumbly is licensed to you under Apple's Licensed Application End User License Agreement (the "Apple EULA"). These terms add to the Apple EULA. If the two ever conflict, the Apple EULA wins.

Your license

We give you a personal, non-exclusive, non-transferable license to use Crumbly on Apple devices you own or control, as allowed by the App Store's usage rules, for your family's personal, non-commercial use.

Purchases

Crumbly is free to download. An optional one-time "Full Bakery" purchase unlocks more stations, levels, and the sticker book. There are no subscriptions. Purchases are made and processed by Apple, which handles payments and refunds. For a refund, use Apple's Report a Problem page. A purchase can be restored on your devices from the app's grown-ups area.

Acceptable use

Please don't copy, modify, sell, or redistribute the app or its content; don't try to reverse engineer it except where the law allows; and don't use it for anything unlawful.

Intellectual property

The app, including its characters, artwork, sounds, text, and code, belongs to homeapps or its licensors and is protected by copyright and other laws. Some parts, such as fonts, are used under their own open licenses, which are credited in the app's materials. These terms don't give you any ownership rights.

For parents and guardians

Crumbly is designed for young children to use with a parent's or guardian's involvement. You're responsible for the app's settings and for your child's screen time. The optional play-time reminder can help.

Disclaimers

We work hard to make Crumbly safe, calm, and useful. It is a playful learning activity, not a substitute for teaching, therapy, or professional advice, and we can't promise specific learning results. To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, and we don't promise that it will always be error-free or uninterrupted.

Limitation of liability

To the extent the law allows, homeapps is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection law.

Apple

These terms are between you and homeapps, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide support or maintenance for it, and isn't responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

Changes

We may update these terms, for example when we add new features. We'll post the new version here with a new effective date. If you keep using the app after that, the new terms apply.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be handled by the state or federal courts located in California, unless the law where you live gives you the right to bring it elsewhere.
